Update on Citizens Property Insurance Arbitration in Florida:

The legal fight over mandatory arbitration in Citizens Property Insurance claims is still unfolding and there is no final answer yet.

Last year, one Florida judge blocked Citizens’ arbitration process in a specific case, raising serious constitutional concerns about how the program was implemented and disclosed to policyholders. However, in a separate ruling in a separate county, another Florida judge ordered arbitration to move forward in hundreds of other pending disputes, creating conflicting decisions across the state.

The issue is now before the Second District Court of Appeal, which is reviewing whether Citizens’ arbitration system complies with Florida law and constitutional protections. At the same time, the Florida Legislature is actively evaluating potential changes to how arbitration provisions must be presented to policyholders, including whether clearer notice or additional safeguards are required.

Bottom line: mandatory arbitration is still being enforced in most Citizens claim disputes for now, but its long-term future remains uncertain. Homeowners with active or denied claims should stay informed, as the outcome of these legal and legislative efforts could significantly impact their rights and options moving forward.
